Note on Legacies

Making a gift to the MBA in your will

Why it’s a good idea to make a will
If you die without making a Will, then the law means that you do not control who gets your money and property. The position in different parts of the UK is explained in this government website: www.gov.uk/inherits-someone-dies-without-will. If you do make a Will then you decide where your property and money goes.

How to make a Will
This government website explains how to make a Will: www.gov.uk/make-will. It says that you can write your Will yourself, but points you to where you can get advice if your Will isn’t straightforward. If you have already made a Will, you can make a new one at any time. However it may be easier (and cheaper) simply to add a charitable donation to your Will as an amendment.

How to leave a legacy to the MBA
You can leave a specific amount of money to the MBA, or you can specify all the other amounts you want to leave to other people and then say that what’s left should go to the MBA. For your Will to benefit the MBA you should specify that the legacy is to go to:
Mountain Bothies Association
A charity registered in Scotland, no. SC008685
A company limited by guarantee and registered in Scotland no. SC 191425
Registered office: Henderson Black & Co, Edenbank House, 22 Crossgate, Cupar, KY15 5HW

How the MBA spends money that is left to them in a legacy
You can make a legacy to be spent on maintaining a specific bothy or group of bothies, and we will then do precisely that. But leaving an unconditional legacy to be used at the discretion of the Trustees is the most flexible option for us. It is the Trustees’ policy to discuss with your executors what use of the legacy would fit with your interests.

Any questions?
The process of making a donation via your Will is straightforward, and we are grateful to those who choose to do so. If you have any questions please contact: MBA Treasurer, Henderson Black & Co, Edenbank House, 22 Crossgate, Cupar, KY15 5HW
